ABSTRACT OF WILLS - LIBER 22 - pages 405 and 406
In the Name of God, Amen. I, JOHN CLEVES, of the town of Southold, in Suffolk County, yeoman, being sick in body. First I give and bequeath unto my endeared wife Mary the use of my dwelling house which I now dwell in, and also the use of all my land which belongs to it which I bought of my son in law, William Terry, while she remains my widow, and also all my household goods or indoor moveables to be at her disposal, and to her grand children after she has down with them; and also 2 cows. All the rest of my movable estate or out door movables I give and bequeath unto my 3 grand sons, John Cleves Symmes, John Cleves Terry, and Timothy Symmes. I make my endeared wife Mary and my beloved kinsman, John Williamson, and my grand son, John Cleaves Symmes, executors, And they are to sell all my land in the Collony of New Jersey and they shall think proper, and with the money they are to pay all just debts. I leave to my grand daughters, Elizabeth Terry, Ruth Terry and Mary Terry, 100 pounds each, to be put out at interest and paid to them when of the age of 21 years. And my executors are to sell all my land at a place called Jericho, which I bought of Mr. Caleb Horton. I leave to my wife 50 pounds, to be disposed of to her grand children as she may see proper, and the remainder of the money I leave to my 3 grand sons. I leave all the rest of my lands to my grand sons, and if they cannot agree to divide, "then they shall choose each one his man," who shall lay out the same in three Divisions, but my grand son, John Cleves Symmes, shall have the first choice, and John Cleves Terry shall have the second choice. All my meadow lands that I bought of Mr. Jonathan Dimon I leave to my grandson, John Cleves Symmes. And whereas I have given a bond to Mr. Isaac Bradfield and Mr. Simon Serren, of New Jersey, for the sum of 500 pounds, that my grand son, John Cleves Symmes, shall give a quittance to a piece of land lying at a place call the Canoe Brook, which was his father's, when he shall be of age, If he refused to do so he shall forfeit 500 pounds out of his portion. Whereas my son in law, Mr. William Terry, has given a bond for 800 pounds, in Jersey money, that he will confirm to my grand son, Thomas Terry, 400 pounds, If he refuses to pay, my executors shall sue for the same, and if it cannot be obtained, then it shall be made up out of the legacies of my grand son, John Cleves Terry, and my 3 grand daughters. I leave to my wife all my winter wheat on the ground for the use of my family. Dated April 3, 1760. Witnesses, Samuel Brown, Hannah Williamson, Israel Youngs. CLEVES - pages 62, 63, 64 and 65
John and Mary (Hallock) Cleves lived one quarter of a mile east of the "meting hous" built at Jamesport, on land he bought in 1722 from Joshua Hempstead of New London, Connecticut. Hempstead had sold this tract as part of the settlement of the estate of his wife, Abigail (Bailey) Hempstead. Abigail was the granddaughter of Margaret Cooper who had received two allotments in the First Aquebogue Division of 1661. The allotments extended from the Sound to the Bay and were located between the present Manor Lane and Herrick's Lane. Apparently, John was the son of John Cleves, who according to the Southold Town Records was living in Cutchogue as early as 1685, when he purchased land from Samuel King. This John, the first to live in Southold Town, may have been the son of George Cleves who came to Portland, Maine, from the English parish of Shrewsbury. On September 6, 1703/4, John Cleves leased land, in what is now the village of Riverhead, from the first Richard Howell. The important contract, reproduced here, provides the earliest documentation of any house in Riverhead Town. The house located on the north side of the Country Road (Main Road) was west of Ostrander Avenue. Probably the Cleve family soon moved from Cutchogue to this house and farm in Riverhead.
John was in the Cutchogue at the time of the 1698 census. His family is listed in the following order: "Eliza Cleaues, Jedediah Cleaues, John Cleaues, Eliza Cleaues Junjr, Mary Cleaues, Hannah Cleaues, John Cleaues Junjr, Abigail Cleaues." "John Cleaues Junjr," born at Cutchogue in 1695, moved with the family to Riverhead about 1704. His father, John, died January 19, 1707 and his mother "Eliza Cleaues," first on the census record, died February 1, 1740, age 75. John Jr., on October 10 1717, married Mary Hallock, the daughter of William and Mary (Horton) Hallock. Mary was born 1697 and died January 16, 1785. "John Cleaues" is on Daniel Wells' account of those that worked. He and his brother, David Cleaves appear with other Jamesport names on the list of Freeholders in Suffolk County, February 27, 1737.
John died May 25, 1759. His will dated April 3, 1760 and proved May 20, 1769, mentions his wife Mary, his son-in-law William Terry, his "beloved kinsman" John Williamson, his grandsons, John Cleves Symmes, John Cleves Terry, Timothy Symmes, and Thomas Terry, and his grand daughters, Elizabeth Terry, Ruth Terry, and Mary Terry. Witnesses to this will included Samuel Brown, Hannah Williamson and Israel Youngs, all residents of Laurel.
Text of the 1703/4 LEASE AGREEMENT Between RICHARD HOWELL and JOHN CLEVES
This indenture made the 6th day of September in ye year of our Lord god; 1703/4; between Richard howell of ye town of Southold in the county of Suffolk on the Island of Nasaw in ye province of new york, yeoman of ye one part and John Cleves of ye town and county afore sd of ye other part witnesseth that ye sd Richard howell doth hereby let out and lett to farm unto him ye sd John Cleves a certain lott of land with one dwelling hous near ye head of Peaconok river within the bounds of sd Southold and purchased of John halliock and two lotts of meadow in ye broad meadows on ye south side of sd river and half my meadow and half my meadow near ye head of sd river which I purchased of thomas Mapes all which land and meadow ye sd howell hath lett to sd Clevs for the full and just term of six years to comence on ye first day of May next ensuing ye date hereof; and lett ye sd Cleves four or six cowes all likely to be with calf and one or two breeding swine all to ye and to furnish ye sd Cleevs with a pair of working oxen and ye sd Cleevs is to do his the sd stock of cattle and swine during ye sd term and at ye end of ye sd term of six years to return ye sd stock with half ye increase and if any of ye stock shall be lost through the sd Cleeves negligence he is to make them good unto ye sd Howell again; but they are to devide ye increas at the three years end, and the sd Cleevs is to lath ye sd waals of sd hous and to sill them up and to make ye oven and to make ye floor and lay ye hearth and what land the sd Cleevs shall improve upon ye sd farm he is to leave well fenst at ye end of sd term; In witness whereof each one on his part hath hereunto set his hand and seal ye day and date above written.

To all people. Know Ye, that I, John Cleeves of Southold, yeoman, in consideration of seven hundred pounds to me paid by Thomas Conkling, son of Henery Conkling of Southold, yeoman, late deceased, do by these presents grant bargain and sell unto the said Thomas Conkling and his heirs forever, all that my lott of land situate in Aquabague first division, with the houses, barns, and building thereon erected, which lott of land containing by estimation one hundred and sixty three acres, is bounded North by Zerubbabell Hallock - East by David Horton - West by David Cleeves partly and partly by Jedediah Cleeves and Nathanael Warner Esq and South by the bay or river - together with a meadow bounded as followeth - North by Nathanael Warner aforesd Esp - West by Benjamin Conkling - South by David Horton - East by the creek - which sd meadow containeth by estimation seven acres.

[NOTE: This valuable farm lies upon the main road from Riverhead to Mattituck, about half a mile east of the old Aquebogue Church; it runs down to the water, and has a long frontage upon Great Peconic Bay. Captain Thomas Conkling, son of Henry, of Hashamomack, who purchased it of John Cleeves, married Hannah Dimon. Captain Conkling died very soon, leaving two sons, Thomas and Dimon. In 1793, his widow married Reverend Benjamin Goldsmith; hod one son, John, who graduated at Princeton, studied theology, was installed Pastor of the Presbyterian Church at Newtown, and died D.D. in 1860. Colonel Thomas, the oldest son of Captain Thomas, married a daughter of the late Judge John Woodhull, and always lived upon the old homestead. He left four sons, Thomas, Henry, Charles and Woodhull; some of them are still at the old homestead. Dimon, the younger brother of Colonel Thomas, for many years Justice of the Peace, had his share of the estate, and lived upon the property adjoining that of his brother Thomas. Reigned 1327-1377. Edward assumed effective power in 1330 after imprisoning
his mother and executing her lover Roger de Mortimer who had murdered his
father; therafter his reign was dominated by military adventures. His victory
in Scotland, especially at Haildon Hill 1333 encouraged him to plan (1363) the
union of England and Scotland. Through his mother he claimed the French throne
thus starting (1337) the Hundred years war. His son John of Gaunt dominated
the government during his last years. Died of a Stroke.
